Illegal Actions by Staff?

Staff Incompetence?

It has come to our attention that a lawsuit has been filed against the HOA.  The suit brought by a former employee alleges the following violations:

1. Disability Discrimination in Violation of Cal. Gov. Code Section 12900 et seq.;
2. Failure to Prevent Discrimination in Violation of Cal. Gov. Code Section 12900 et seq.;
3. Failure to Accommodate in Violation of Cal. Gov. Code Section 12900 et seq.;
4. Retaliation in Violation of Cal. Gov. Code Section 12900 et seq.;
5. Retaliation in Violations of Cal. Labor Code §1102.5; and
6. Wrongful Termination In Violation of Public Policy

While the case has yet to be adjudicated, it will most likely end in one of two ways. Either the HOA will settle to avoid the cost of a trial, or the HOA will go to trial which will cost the HOA huge legal fees, and if found to be at fault, penalties on top of the litigation cost. No matter what, the HOA will spend your dues money on staff actions. The suit specifically names Kyle Bodyfelt, Jeff Caponera, human resources manager Christina McClung.
